Terms of Service for Dear Mama Mail

These Terms and Conditions (the “Terms”) govern the use of www.dearmamamail.com (the “Site”).
This Site is owned and operated by House on the River Media and represents the Dear Mama Mail brand, operated by Amy Sullivan.
This Site is an e-commerce website.
By accessing or using this Site, you indicate that you have read and understood these Terms and agree to abide by them at all times.
Intellectual Property
All content published and made available on our Site is the property of House on the River Media and the Site’s creators.
This includes, but is not limited to, images, text, logos, documents, downloadable files, and anything that contributes to the composition of our Site.
Sale of Goods
These Terms govern the sale of goods available on our Site.
The goods available include:
Monthly postcard subscriptions
Gift cards
All information, descriptions, and images provided about our goods are as accurate as possible. However, we cannot guarantee complete accuracy, and you agree to purchase goods from our Site at your own discretion.
We reserve the right to modify, reject, or cancel any order when necessary.
If we cancel your order after payment has been processed, you will receive a full refund.
It is your responsibility to check your payment method to verify receipt of any refund.
Subscriptions
Subscriptions do not automatically renew.
All subscriptions are pre-paid in full at the time of purchase.
When your final card in a package has been mailed, we will contact you to see if you’d like to continue for another term.
Payments
We accept the following payment methods on our Site:
Credit Card
When you provide us with payment information, you authorize us to charge the amount due using your selected payment method.
If we believe your payment has violated any law or these Terms, we reserve the right to cancel or reverse the transaction.
Shipping and Delivery
Orders and subscriptions are shipped through standard mail delivery.
United States: Cards are mailed on or around the 15th of each month.
Canada: Cards are mailed near the end of each month.
Welcome cards are mailed immediately after sign-up so you’ll never wait long to receive your first note of encouragement.
Delivery times may vary due to postal service delays, holidays, or unforeseen circumstances. Delivery estimates do not include weekends or statutory holidays.
You will not be charged additional shipping fees on any order placed through our Site.
If you purchase goods for delivery outside Canada, your order may be subject to import duties or taxes imposed by the destination country. These are your responsibility. Please contact your local customs office for more details before purchasing.
You must provide a complete and accurate delivery address, including the recipient’s name. We are not liable for mis-delivery due to incomplete or incorrect address information provided by you.
Consumer Protection Law
Where the Consumer Protection Act or other similar legislation in your jurisdiction applies and cannot be excluded, these Terms will be interpreted subject to that legislation.
If a conflict arises, the mandatory provisions of the applicable consumer protection laws will prevail.
Limit of Liability
To the fullest extent permitted by law, Amy Sullivan, House on the River Media, and their directors, officers, agents, employees, subsidiaries, and affiliates shall not be liable for any actions, claims, losses, damages, liabilities, or expenses (including legal fees) arising from your use of the Site or any products purchased through it.
Indemnity
Except where prohibited by law, by using this Site you agree to indemnify and hold harmless Amy Sullivan and House on the River Media, including all associated directors, officers, agents, employees, and affiliates, from any claims, damages, liabilities, or expenses (including legal fees) that result from your use of the Site or your violation of these Terms.
Applicable Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada.
Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be deemed void and removed. The remaining provisions will continue to be valid and enforceable.
Changes
These Terms of Service may be amended periodically to remain compliant with law and reflect changes to our operations.
When changes are made, the updated version will be posted on this page and the “Effective Date” will be revised.
We may also notify customers by email if significant changes occur.
